The Senate's ACA Tax Credit Debate: Will Republicans and Democrats Find Common Ground?
The government shutdown has brought a critical issue to the forefront: the future of Affordable Care Act (ACA) tax credits. In a bold move, Senator John Fetterman (D-Pa.) has suggested that Senate Majority Leader John Thune (R-S.D.) would be open to genuine discussions about extending these tax credits once the government resumes operations. But here's where it gets controversial—Fetterman supports the GOP's plan to eliminate the Senate filibuster, a move that could significantly shift the balance of power.
Fetterman emphasized the need for senators to walk a fine line, advocating for government funding while also fighting for healthcare subsidies, which are at the heart of the ongoing shutdown. He believes that keeping the government open is the primary duty of senators, and only then should they negotiate the extension of tax credits. While backing his own party leader, Chuck Schumer (D-N.Y.), Fetterman also acknowledged the potential benefits of the 'nuclear option,' which would allow Senate Republicans to pass a funding measure with a simple majority vote, bypassing the usual 60-vote requirement. This strategy could expedite the reopening of the government.
Democrats, however, are hesitant to support the GOP's funding proposal without first addressing the imminent expiration of ACA subsidies, which would lead to higher health insurance premiums for millions. They argue that a mere promise to vote on subsidies after the government reopens is not sufficient to ensure Republicans' commitment to fair negotiations.
But Fetterman remains optimistic, believing that Republicans also want to find a solution for their constituents facing premium increases. He thinks that many Republicans will be motivated to address this issue due to the potential impact on their voters.
Adding to the pressure, a group of House Republicans urged Speaker Mike Johnson (R-La.) to take immediate action on the expiring ObamaCare tax credits once the shutdown concludes. This plea is backed by a KFF analysis, which revealed that most ACA marketplace enrollees (77%, or 18.7 million) reside in states won by President Trump in 2024, where premium tax credits are higher and enrollment growth is more significant.
A KFF survey further highlights the public's desire for action, with 78% of adults, including a majority of Democrats, independents, and even Republicans, favoring the extension of enhanced ACA tax credits. And this is the part most people miss—the public's voice is a powerful force that could influence the outcome of these negotiations.
